Abstract: |
The attached exposure draft and draft explanatory memorandum relate to proposed minor amendments to the taxation laws. The amendments seek to ensure the law operates as intended, by correcting technical or drafting defects, removing anomalies and addressing unintended outcomes. The minor amendments are part of the Government’s commitment to the care and maintenance of the taxation laws. Minor amendment packages can include addressing issues raised through the Tax Issues Entry System (TIES). The TIES website (www.ties.gov.au), operated jointly by the Australian Taxation Office and Treasury, provides a vehicle for tax professionals and the general public to raise issues relating to the care and maintenance of the tax system. The community’s views are sought on the proposed package of amendments. The proposed amendment to capital gains tax legislation applicable to foreign residents to ensure that real property includes a lease over land applies to CGT events happening on or after 20 May 2009, the date on which the amendment was first foreshadowed through the release of this exposure draft. While submissions may be lodged electronically, by post or by facsimile, electronic lodgment is preferred. For accessibility reasons, please submit responses sent via email in a Word or RTF format. An additional PDF version may also be submitted. All information (including name and address details) contained in submissions will be made available to the public on the Treasury website unless you indicate that you would like all or part of your submission to remain in confidence.
