This document was authored by the then Department of Industry, Innovation and Science as part of the Small Business portfolio policy functions which have since been transferred to the Treasury.

The relationship between new car dealers and manufacturers are subject to the Franchising Code of Conduct, a mandatory code of conduct under the Competition and Consumer Act 2010.

New car dealers have raised concerns about the fairness of the franchise arrangements with their car manufacturer franchisors, suggesting that the Franchising Code of Conduct is insufficient.

We have developed a Regulation Impact Statement (RIS) canvassing possible responses to address new car dealers’ franchising concerns. We will use the feedback obtained through this consultation process to inform development of advice to the Government.

We will also hold a roundtable in Canberra with industry representatives and schedule one-on-one meetings with stakeholders. Please email us if you wish to meet.
